This paper considers three modes of captivity with an eye to examining the effects of captivity on free agency and whether these modes depend on or constitute coercion. These modes are: physical captivity, psychological captivity, and social/legal captivity. All these modes of captivity may severely impact capacities a person relies on for free agency in different ways. They may also undermine or destroy a person’s identity-constituting cares and values. On a Nozick-style view of coercion, coercion amounts to conditional threats and (...) so many of the processes creating captivity are not coercive. However, this view overlooks the role that barriers to action play in making threats effective. Thus, an enforcement view of coercion is better to understand the coercion that takes place in captivity but the effects of the use of power on a captive’s psychology remains an important area of investigation. Susan Wolf's paper "Meaning and Morality" draws our attention to the fact that Williams's objection to Kantian morality is primarily a concern about a possible conflict between morality and that which gives our lives meaning. I argue that the force of Williams's objection requires a more precise understanding of meaning as dependent on our intention to make our lives themselves worthwhile. It is not meaning simpliciter that makes Williams's objective persuasive but rather meaning as arising out of our positive evaluation (...) of the value of our lives as a whole. This type of meaning has a normative element: it involves a person's deep-seated commitment to make her actions consistent with ends that confer worth on her life itself. The more significant conflict with morality lies in the conflict between the normative force of moral requirements and the normative force of the need to have a life that is itself worthwhile. Beneficence is usually regarded as adequate when it results in an actual benefit for a beneficiary and satisfies her self-chosen end. However, beneficence that satisfies these conditions can harm beneficiaries' free agency, particularly when they are robustly dependent on benefactors. First, the means that benefactors choose can have undesirable side-effects on resources that beneficiaries need for future free action. Second, benefactors may undermine beneficiaries' ability to freely deliberate and choose. It is therefore insufficient to satisfy someone's self-chosen ends. Instead, good (...) beneficence depends on whether the benefactor avoids undue influence over a beneficiary's deliberation and whether the choice of means is compatible with the beneficiary's conception of her good. Consequently, benefactors must have substantial respect for a beneficiary's free agency and the practical competence to choose means that take into account the beneficiary's conception of her good and the wider set of circumstances that influence her life. When a person gives up an end of crucial importance to her in order to promote a moral aim, we regard her as having made a moral sacrifice. The paper analyzes these sacrifices in light of some of Bernard Williams’ objections to Kantian and Utilitarian accounts of them. Williams argues that an implausible consequence of these theories is that that we are expected to sacrifice projects that make our lives worth living and contribute to our integrity. Williams’ arguments about integrity (...) and meaning are shown to be unconvincing when the content of projects is left open. However, a look at his later arguments suggests a reason to be concerned about defensible ethical projects as understood through what he refers to as “the morality system”. The problem for theories of this type turns out to be not merely conflicts between ethical projects and moral demands but making sense of some of the ethically relevant features of these projects. Accommodations to moral theories that leave room for ethical projects may be insufficient to explain such features, for example in cases where agents demand more of themselves than the theories require. Making the theories more demanding is also problematic. Williams’ view about the role ethics plays in our conception of the life we want to lead provides a better account of these cases. (shrink)

The priority that Tessman’s argument gives to phenomenological and neuropsychological explanations of moral requirements entails a fundamental shift in our understanding of these. Two central problems of normative theory come together in Tessman’s account. The first arises when an agent’s sense of requirement clashes with what a systematic theory prescribes. The second arises when neuropsychological accounts fail to fit the prescription. Tessman argues that no account successfully resolves moral dilemmas such that ought always implies can, and she argues that neuropsychology (...) explains our sense of impossible requirements. This explanation eliminates the role of a prescriptive theory in explaining an agent’s sense of requirement. (shrink)

This paper argues that the diversity of conflicting comprehensive doctrines in liberal pluralist societies raises a problem of estrangement between citizens and the basic structure of society that Rawls' version of political liberalism does not successfully solve. 'Political estrangement' occurs when someone refuses to accept a political outcome that favors a comprehensive doctrine she rejects, based on what she imagines, correctly or incorrectly, to be true of her fellow citizens' comprehensive doctrines and their effect on political outcomes. Rawls argues that (...) the political conception of justice and the use of public reason ensure the incompatibility of our comprehensive doctrines will not undermine our willingness to to accept political decisions contrary to our own values. However, public reason does not guarantee this result. Imagination can allow us to see that the influence of some reasonable comprehensive doctrines can lead to oppressive political outcomes and public reason restricts us from addressing this fact. Yet, widening public reason to account for this problem is likely to increase the conditions that cause estrangement. The paper concludes that the political conception of justice and public reason may sometimes fail to adequately justify political outcomes in the sense Rawls hopes. (shrink)

Suicide among Veterans experiencing or at risk for homelessness remains a significant public health concern. Conducting research to understand and meet the needs of this at-risk population remains challenging due to myriad factors. To address this challenge, the United States Department of Veterans Affairs convened the Health Services Research and Development Suicide Prevention in Veterans Experiencing Homelessness: Research and Practice Development meeting, bringing together subject-matter experts in the fields of homelessness and suicide prevention, both from within and outside of VA. (...) During the meeting, attendees identified 10 potential research priorities at the intersection of suicide prevention and homelessness. After the meeting, Delphi methodology was used to achieve consensus on the relative importance of the identified research domains. Through this iterative Delphi process, agreement was reached regarding the need to increase understanding of barriers and facilitators to suicide risk assessment and emergency intervention for Veterans experiencing homelessness by examining the perspectives of both Veterans and healthcare providers. Elucidating the complex relationships between risk periods, subgroups, suicide means, and drivers of suicide among Veterans experiencing homelessness was also considered a top priority. This article documents the Delphi process and provides a research agenda for researchers, funding agencies, and policymakers to prioritize the most relevant and potentially impactful research domains aimed at preventing suicide among Veterans experiencing or at risk for homelessness. If We Were Kin is about the we of politics-how that we is made, fought over, and remade-and how these struggles lie at the very core of questions about power and political change. While reigning frameworks in the study of politics leave forms of identification sedimented in the background as a priori identities or prop them up front as a part of a mechanistic and calculated game, political identification cannot be captured by these frameworks and is a far more significant (...) and profound political process than they allow. While this book stakes a wider claim about the centrality of identification to politics, it attends most closely to its deeper registers, and in particular to attempts by political actors within racial and gender justice and queer and trans liberation movements to get people to shift or reshape their foundational identifications. Drawing on the political thought of Sylvia Rivera, James Baldwin, Lorraine Hansberry, and grassroots LGBTQ activists in Southerners On New Ground, I identify a distinct lineage of calls which challenge the atomized and hierarchical racial formations that structure political life in the United States and advance powerful visions of political relationships rooted in mutuality and shared freedom. As I trace through activist archives, political speeches, and original interviews, these appeals demand not only a rethinking of fundamental assumptions in the study of politics, but provide critical resources for understanding the way power works in struggles to constitute a we, how commitments towards or away from racial justice are cultivated through battles over identification, and the dangers and possibilities of identificatory appeals. I briefly introduce Moral Failure as a book that brings together philosophical and empirical work in moral psychology to examine moral requirements that are non-negotiable and that contravene the principle that “ought implies can.” I respond to Rivera by arguing that the process of construction that imbues normative requirements with authority need not systematize or eliminate conflicts between normative requirements. My response to Schwartzman clarifies what is problematic about nonideal theorizing that limits itself to offering action-guidance. In response to (...) We argue that corporate social performance (CSP) has become a legitimizing identity (brand) for researchers in the business and society field, but it has not developed into a viable theoretical or operational construct. Because measuring CSP is contingent on the operational setting (industry, issues, etc.), it is difficult to produce worthwhile comparisons across studies or generalizing beyond the boundaries of a specific study. The authors suggest that researchers remove the CSP label from their operational variables, and instead narrowly define their (...) studies in operational terms. They provide aworking example of the proposed research direction by examining the theory underlying the popular CSP–financial performance (FP) debate. In the authors’ conceptualization, stakeholder action provides the underlying logic connecting CSP-FP, and we recast the research question to investigate the conditions under which stakeholders will take action to influence the focal organization and when those actions will influence the CSP-FP link. The contribution of this work is a classification of corporate social action underlying the Social Ratings Data compiled by Kinder Lydenburg Domini Analytics, Inc. We compare extant typologies of corporate social action to the results of our exploratory factor analysis. Our findings indicate four distinct latent constructs that bear resemblance to concepts discussed in prior literature. Akey finding of our research is that positive and negative social action are both empirically and conceptually distinct constructs and should not be combined in (...) future research. Additionally, we recommend that some prior research results be reconsidered to determine whether these newly derived measures might clarify some previous findings. (shrink)

BackgroundAs a number of commentators have noted, SARS exposed the vulnerabilities of our health care systems and governance structures. Health care professionals (HCPs) and hospital systems that bore the brunt of the SARS outbreak continue to struggle with the aftermath of the crisis. Indeed, HCPs – both in clinical care and in public health – were severely tested by SARS. Unprecedented demands were placed on their skills and expertise, and their personal commitment to their profession was severely tried. Many were (...) exposed to serious risk of morbidity and mortality, as evidenced by the World Health Organization figures showing that approximately 30% of reported cases were among HCPs, some of whom died from the infection. Despite this challenge, professional codes of ethics are silent on the issue of duty to care during communicable disease outbreaks, thus providing no guidance on what is expected of HCPs or how they ought to approach their duty to care in the face of risk.DiscussionIn the aftermath of SARS and with the spectre of a pandemic avian influenza, it is imperative that we (re)consider the obligations of HCPs for patients with severe infectious diseases, particularly diseases that pose risks to those providing care. It is of pressing importance that organizations representing HCPs give clear indication of what standard of care is expected of their members in the event of a pandemic. In this paper, we address the issue of special obligations of HCPs during an infectious disease outbreak. We argue that there is a pressing need to clarify the rights and responsibilities of HCPs in the current context of pandemic flu preparedness, and that these rights and responsibilities ought to be codified in professional codes of ethics. Finally, we present a brief historical accounting of the treatment of the duty to care in professional health care codes of ethics.SummaryAn honest and critical examination of the role of HCPs during communicable disease outbreaks is needed in order to provide guidelines regarding professional rights and responsibilities, as well as ethical duties and obligations. Nurses and other medical practitioners often experience moral distress: they feel an anguished sense of responsibility for what they take to be their own moral failures, even when those failures were unavoidable. However, in such cases other people do not tend to think it is right to hold them responsible. This is an interesting mismatch of reactions. It might seem that the mismatch should be remedied by assuring the practitioner that they are not responsible, but I argue that this denies (...) something important that the phenomenon of moral distress tells us. In fact, both the practitioners’ tendencies to hold themselves responsible and other people’s reluctance to hold the practitioners responsible get something right. The practitioners may be right that they are responsible in the sense of having failed to meet a binding moral requirement, even when the requirement was impossible to meet. This makes moral distress a fitting response because it correctly represents their own action as a wrongdoing. However, others may meanwhile be right that the practitioners are not responsible in the sense of being culpable and blameworthy. To blame others, or oneself, for certain failures, including those that are unavoidable, would be unfair. My claim depends on distinguishing between the fittingness and the fairness of holding someone (including oneself) responsible for moral failure. Having drawn the distinction, I suggest that moral distress should be addressed in a way that both recognizes it as a fitting response and avoids the unfairness of blame. (shrink)

Psychologists and philosophers who pose moral dilemmas to understand moral judgment typically specify outcomes as certain to occur in them. This contrasts with real-life moral decision-making, which is almost always infused with probabilities (e.g., the probability of a given outcome if an action is or is not taken). Seven studies examine sensitivity to the size and location of shifts in probabilities of outcomes that would result from action in moral dilemmas. We find that moral judgments differ between actions that result (...) in an equal increase in probability of harm (equal size), but have different end-states (e.g., an increase in harm probability from 25% to 50% or from 50% to 75%). This deviation from expected value is robust under separate evaluation, and increases when the comparison between shifts is made explicit under simultaneous evaluation. Consistent with the centrality of perceived harm in some models of moral judgment, perceived harm partially mediates sensitivity to location of harm probability shift. Unlike for shifts in harm probabilities, participants are insensitive to the location of shifts in probability of beneficial outcomes. They are also insensitive to the location of shifts in probability of analogous monetary losses and gains, suggesting an asymmetry between harm and benefit in moral reasoning, as well as an asymmetry between moral and monetary decision-making more broadly. Implications for normative philosophical theory and moral psychological theory, as well as practical applications, are discussed. (shrink)

We offer a defense of one aspect of Paul Horwich’s response to the Liar paradox—more specifically, of his move to preserve classical logic. Horwich’s response requires that the full intersubstitutivity of ‘ ‘A’ is true’ and A be abandoned. It is thus open to the objection, due to Hartry Field, that it undermines the generalization function of truth. We defend Horwich’s move by isolating the grade of intersubstitutivity required by the generalization function and by providing a new reading of the (...) biconditionals of the form “ ‘A’ is true iff A.”. Though sometimes perceived as a secondary figure, there have been some attempts to recover him as one of, if not (...) the first "sociologist." 1 Much has been written about Ferguson's contribution to modern social science; 2 this article focuses upon his highly prescient work in the area of conflict theory. It is important to note at the outset, however, that Ferguson's inspiration for these apparently novel insights is classical. His early social theory is curious because it "straddles traditions"; 3 on the one hand he owes a profound debt to classical civic humanism, [End Page 281] but on the other his work quite authentically signposts the emergence of social science proper. This bridging of traditions in Ferguson is a key theme of this paper.Ferguson relies heavily upon conflict in his explanation of historical processes and in the securing of social order. Conflict generates many positive unintended consequences; it leads to the formation of the state, formal defense institutions, and large scale communities; and it plays a pivotal role in the development of the moral personality and contributes to the maintenance of stability and social cohesion. Conflict preserves the balance of powers in government and prevents the encroachment of despotism. In this regard, then, conflict cannot be regarded as wholly unnecessary, destructive, or undesirable but as integral to progress and the march towards civilization. 4Gladys Bryson has noted that Ferguson's exposition of conflict was original with him and "set him off from the conventional position of his century." 5 Even so the benefits of conflict and dissension had been canvassed long before by Tacitus and Machiavelli, both of whom influenced Ferguson's analysis. 6 In it he challenges the false dichotomy promulgated by contractarians of tranquil society on the one hand and violent, isolated chaos on the other; rather, he argues, we are social beings with belligerent tendencies. He also confronts the Aristotelian (and later Hobbesian) premise that the key purpose of society is stability and social harmony. Instead, Ferguson lays great stress on the positive benefits of competition and conflict in our social development and in the maintenance of community. To reduce the global burden of the COVID-19 pandemic, there is an urgent need to develop a safe vaccine. Vaccine development usually takes many years as it goes through several different phases. To hasten COVID-19 vaccine development, it has been suggested that the final stage could be replaced with a human challenge trial (HCT). Volunteers would be intentionally infected with SARS-CoV-2 to see how the vaccine candidate works. To intentionally infect a healthy human being with a potentially deadly virus is (...) contrary to the highest ethical standards in medical research. This article highlights the benefits and risks of COVID-19 HCTs and summarises what research ethics committees (RECs) need to consider during the ethical assessment of such trials including risk reduction, strict containment measures, specific informed consent measures and avoiding high monetary inducements. The second annual Alchemy Lecture was presented in November 2023 at York University to a sold out in-person audience and nearly one thousand live online viewers. Moderated by Christina Sharpe, the Alchemists-agile thinkers and practitioners working across a range of disciplines and geographies-convened to discuss their radical visions of the beautiful world, and the manifestos that may help to guide us there. Their treatises have been captured and luminously expanded in the pages of this book. Cherokee Nation citizen and professor (...) Joseph M. Pierce asserts that "[f]or this decolonial future to become possible, the guiding force must no longer be capital but relations." Informed by her practice of "curation as care," Brazilian film curator Janaína Oliveira evokes music and movement as a means toward this relationality: "it's almost by falling that you live.... The beautiful world dances the stumbles. The beautiful world dances dancing." Kenyan-British visual artist Phoebe Boswell uses the space of a virtual gallery to ask, "If we burn down the institution, what happens next? Do we trust ourselves to know?" and gestures toward the possibility of this "as yet unlived, unexperienced thing." Professor and MacArthur fellow Saidiya Hartman asks us to consider our capacity to burn, stating that "[P]ragmatism yields a profound tolerance of the unlivable." And Mexican-American author Cristina Rivera Garza gives us the language of the future in the subjunctive, which "lays the groundwork for the irruption.... The subjunctive is the smuggler who crosses the border of the future bearing unknown cargo." Linear chromosomes shorten in every round of replication. In Drosophila, telomere‐specialized long interspersed retrotransposable elements (LINEs) belonging to the jockey clade offset this shortening by forming head‐to‐tail arrays at Drosophila telomere ends. As such, these telomeric LINEs have been considered adaptive symbionts of the genome, protecting it from premature decay, particularly as Drosophila lacks a conventional telomerase holoenzyme. However, as reviewed here, recent work reveals a high degree of variation and turnover in the telomere‐specialized LINE lineages across Drosophila. There appears (...) to be no absolute requirement for LINE activity to maintain telomeres in flies, hence the suggestion that the telomere‐specialized LINEs may instead be neutral or in conflict with the host, rather than adaptive. Why do sports fans sometimes (often?) go crazy at sporting events and then afterwards proceed with their day as if nothing much happened? If something of genuine significance happened, something that warranted the emotional ups and downs the fan experienced during the game, why don’t its effects linger? These questions pose a version of the puzzle of sports fandom. Others have applied Kendall Walton’s theory of fiction to solve the puzzle, but Walton’s account of sports fandom fiction is unacceptably thin. (...) Recent attempts by Nathan Wildman and Joseph Moore to address this thinness problem fail. We answer the thinness objection by explaining how sports fandom is a collaboratively authored fiction, constructed by fans, sponsors, players, teams, media commentators, and more. The stories of sports fandom fiction are passed to new generations of fans in a way more reminiscent of The Iliad or The Romance of the Three Kingdoms. Sports fandom fiction is more like folklore, and less like a novel. (shrink)

Objective: Evidence suggests people experience an oral size illusion and commonly perceive oral size inaccurately; however, the nature of the illusion remains unclear. The objectives of the present study were to confirm the presence of an oral size illusion, determine the magnitude (amount) and direction (underestimation or overestimation) of the illusion, and determine whether immediately prior crossmodal perceptual experiences affected the magnitude and direction. Design: Participants (N = 27) orally assessed 9 sizes of stainless steel spheres (1/16 in to 1/2 (...) in) categorized as small, medium, or big, and matched them with digital and visual reference sets. Each participant completed 20 matching tasks in 3 assessments. For control assessments, 6 oral spheres were matched with reference sets of same-sized spheres. For primer-control assessments, similar to control, 6 matching tasks were preceded by cross-modal experiences of the same-sized sphere. For experimental assessments, 8 matching tasks were preceded by a cross-modal experience of a differently sized sphere. Results: For control assessments, small and medium spheres were consistently underestimated, and big spheres were consistently overestimated. For experimental assessments, magnitude and direction of the oral size illusion varied according to the size of the sphere used in the cross-modal experience. Conclusion: Results seemed to confirm an oral size illusion, but direction of the illusion depended on the size of the object. Immediately prior cross-modal experiences influenced magnitude and direction of the illusion, suggesting that aspects of oral perceptual experience are dependent upon factors outside of oral perceptual anatomy and the properties of the oral stimulus. While communities engaged in liberatory struggles have valued group loyalty and condemned betrayal, loyalty itself may be problematic, because remaining loyal to a community may require that one refrain from deconstructing the group identity on which the community is based. This essay investigates what loyalty is and whether loyalty is a virtue, and considers why, if loyalty is indeed a virtue, it may be one that is difficult to maintain in a context of oppression.

Evolutionary theory guides an investigation of foster parent selection in two northern Thai villages with different biosocial environments: one village has high levels of labour migration and divorce, and growing numbers of parental death due to HIV/AIDS, while the other village has lower migration, divorce and parental mortality levels. Focus groups examine mothers motivations and ideals regarding foster caretaker selection, and quantitative family surveys examine real fostering outcomes: specifically, the laterality (matrilateral versus patrilateral) and genetic distance of the foster caretakers (...) of all ever-fostered children in these two villages. As predicted, in environments of high marital stability and paternity certainty, parents seem to prefer close genetic kin from either side as foster parents for their children. In low marital stability and paternity certainty environments, parents trust their own lateral kin, regardless of genetic distance, over close genetic kin from the other side. The striking exception to this pattern, however, occurs in the case of parental death, in which case children are fostered to the deceased parents sex or other factors. In general, the foster parents for girls are selected with more care, reflecting the daughter/female preference expected in traditionally matrilineal, matrilocal societies. An ordered decision-making pathway for foster parent selection is proposed, taking into consideration the key factors of (a) the circumstances driving the fostering decision, (b) the gender of the child, (c) the gender of the key decision-making parent, and (d) the degree of marital and population fluidity (and subsequent paternity certainty) in the village. Software piracy is an instance of unauthorized duplication of information goods where laws and norms are not agreed-upon. This article presents a content analysis of articles from the five highest circulating U.S. newspapers 1989-2004 as evidence of the prevailing social environment surrounding software piracy. The rationales in the news articles are analyzed as evidence of the social and psychological underpinnings of attitudes toward software piracy. An expanded version of Sykes and Matza's (American Sociological Review 22, 664-670, 1957); Zamoon and Curley (...) (Working paper, Kuwait University, Kuwait, 2007) neutralization framework is applied to analyze the content of the articles. We found that rationales condoning piracy showed a more balanced use of neutralization approaches, and less moral intensity toward the behavior. In contrast, rationales condemning piracy mostly promoted the injury aspect of software piracy, and suggested higher moral intensity. The discrepancies have practical implications as a barrier to the ability to connect the two sides of the debate concerning software piracy. (shrink)
